Dog Bite Claims:
If you have been bitten by a dog, it is important that you identify the owner of the animal and verify if the rabies shots are current. You should also call your local animal control agency and report the incident. Finally, you should ask the dog’s owners for their homeowner’s insurance information. In order to be successful in pursuing a dog bite claim, you must be able to prove that the dog had prior vicious propensities that the owner knew or should have known about. Some breeds of dogs are recognized as inherently vicious so a prior history is not necessary to prove. Slip and Fall or Trip and Fall Claims (Premises Liability):
Premises liability claims can often be difficult to prove. Just because a person falls on someone else’s property does not necessarily mean there is automatically a claim to pursue. You must be able to prove that the owner of the property knew or should have known of the dangerous condition that caused the fall and failed to correct the dangerous condition. For example, in a slip and fall case where there is liquid on the floor, you have to have solid proof that the owner knew the liquid was on the floor and failed to clean it up. Unless the owner (or one of the owner’s employees) is willing to state he or she knew the liquid was there and ignored it, the likelihood of winning your claim is slim. It is important to get the names and contact information of all potential witnesses.
